These Platform Terms of Service apply to your access to and use of the KloudStack platform, managed cloud hosting services, support services, automation tools, AI-assisted features, and related services provided by KloudStack.
These terms are separate from our Website Terms of Use, which apply to general use of the KloudStack website.
By creating an account, using the KloudStack platform, subscribing to a KloudStack service, or otherwise accessing our services, you agree to these Platform Terms of Service.
If you are using the services on behalf of a company, organisation, or other legal entity, you confirm that you have authority to accept these terms on behalf of that entity.
1. About KloudStack
KloudStack provides managed cloud hosting, cloud stack deployment, platform management, monitoring, automation, and related support services.
Our services are designed to help customers deploy, manage, monitor, and optimise application stacks using cloud infrastructure, automation workflows, and human-guided support.

2. Services covered by these terms
These terms apply to the KloudStack platform and related services, including:
- managed cloud hosting services;
- managed WordPress and CMS hosting services;
- deployment and provisioning of cloud infrastructure;
- customer dashboard and account access;
- monitoring, diagnostics, reporting, and performance insights;
- security, WAF, CDN, and edge configuration support;
- AI-assisted diagnostics, automation, and recommendations;
- support, feedback, and service communication channels;
- billing, subscription, and usage-based charging services;
- documentation, APIs, tools, and platform features made available by KloudStack.
Additional service-specific terms, order forms, statements of work, support terms, or service descriptions may also apply. If there is a conflict between these Platform Terms and a signed written agreement between you and KloudStack, the signed written agreement will apply to the extent of the conflict.
3. Account registration and access
To use the KloudStack platform, you may need to create an account and provide accurate account, company, billing, and contact information.
You are responsible for:
- maintaining the confidentiality of your login credentials;
- ensuring only authorised users access your account;
- keeping account and billing information up to date;
- promptly notifying KloudStack of unauthorised access or suspected compromise;
- ensuring your users comply with these terms.
You are responsible for all activity that occurs under your account, unless the activity was caused by KloudStack’s own unauthorised access or security failure.
4. Customer responsibilities
You are responsible for the content, applications, data, plugins, themes, users, credentials, DNS records, domain names, configurations, and third-party integrations you use with the services.
You must ensure that your use of the services:
- complies with applicable laws and regulations;
- does not infringe third-party rights;
- does not involve unlawful, harmful, abusive, fraudulent, or malicious activity;
- does not interfere with the security, integrity, or availability of KloudStack, other customers, or third-party systems;
- does not involve spam, phishing, malware, botnets, credential abuse, denial-of-service activity, or unauthorised scanning;
- does not attempt to bypass usage limits, security controls, authentication systems, or billing mechanisms.
You are responsible for making sure your website, application, content, and business activities are lawful and appropriate for hosting on the KloudStack platform.
5. Managed services and shared responsibility
KloudStack provides managed support and platform services, but cloud hosting remains a shared responsibility between KloudStack and the customer.
KloudStack is generally responsible for managing the platform services we provide, which may include deployment workflows, hosting configuration, infrastructure monitoring, support processes, and agreed managed stack operations.
You are generally responsible for your own business content, website content, application behaviour, users, third-party plugins, third-party code, DNS decisions, customer data, and instructions provided to KloudStack.
Unless expressly agreed in writing, KloudStack is not responsible for issues caused by:
- customer-supplied code, themes, plugins, content, or data;
- third-party plugins, extensions, integrations, or APIs;
- unauthorised access caused by weak, reused, or compromised customer credentials;
- DNS changes or domain configuration changes made by you or your providers;
- changes made by customer users or third-party administrators;
- malware or vulnerabilities introduced through customer-controlled applications or content;
- third-party cloud, payment, email, domain, DNS, or software providers outside KloudStack’s control.
6. Platform deployments and infrastructure
KloudStack may deploy and manage cloud infrastructure, hosting services, databases, storage, edge services, monitoring, and related resources as part of your selected plan or service.
Deployment times, availability, capacity, and performance may depend on factors outside KloudStack’s direct control, including third-party cloud providers, DNS propagation, payment status, software dependencies, customer configuration, and external network conditions.
KloudStack may update, modify, replace, scale, restart, suspend, or reconfigure platform components where reasonably required to provide, protect, maintain, or improve the services.
Where practical, KloudStack will use reasonable efforts to minimise disruption and provide notice of planned maintenance or material changes.
7. AI-assisted automation and recommendations
KloudStack may provide AI-assisted features, agents, diagnostics, recommendations, summaries, remediation suggestions, or automation workflows.
AI-assisted features are designed to support operational decision-making, diagnostics, and platform management. They do not replace professional judgment, customer review, or human oversight.
You acknowledge that AI-assisted outputs may be incomplete, inaccurate, or require further review. You are responsible for reviewing and approving material actions before they are applied, especially where they may affect production systems, data, billing, security, availability, or customer experience.
KloudStack may require approval before carrying out certain actions, including actions that may restart services, modify production configuration, update software, change DNS-related settings, alter security rules, or affect availability.
8. Billing, subscriptions, and payment
KloudStack services may be billed on a subscription, usage-based, fixed-fee, overage, project, or custom basis.
You agree to pay all fees, charges, taxes, overages, and other amounts associated with your selected plan, order, subscription, or service.
Billing may include:
- base monthly service fees;
- usage-based cloud resource charges;
- overage charges;
- support or managed service fees;
- setup, migration, or project fees;
- applicable taxes;
- other charges described in your plan, order, invoice, or agreement.
KloudStack may use third-party payment and billing providers, including Stripe, to process payments, subscriptions, invoices, and billing records.
If payment fails, is overdue, or cannot be processed, KloudStack may notify you and may suspend or restrict access to the services until payment is resolved.
You are responsible for maintaining valid payment details and ensuring that billing information is accurate and up to date.
9. Trials, promotions, and plan changes
KloudStack may offer trials, beta access, discounts, promotional credits, or early-access services.
Trials, promotions, or credits may be changed, limited, extended, or withdrawn at KloudStack’s discretion, unless otherwise agreed in writing.
If you upgrade, downgrade, cancel, or change your plan, the change may affect pricing, features, usage limits, support levels, resource allocation, or service availability.
10. Support and feedback
KloudStack may provide support through email, support portals, ticketing systems, documentation, platform messaging, or other support channels.
Support and feedback workflows may be managed through third-party systems, including Atlassian products such as Jira Service Management.
Support availability, response times, and resolution times may vary depending on your plan, the nature of the issue, operational priority, and whether the issue involves KloudStack-managed services, third-party services, or customer-controlled systems.
KloudStack may use support requests, feedback, and diagnostic information to improve the platform, troubleshoot issues, identify product improvements, and support customer operations.
11. Acceptable use
You must not use the services to host, transmit, process, or support:
- malware, ransomware, spyware, botnets, or harmful code;
- phishing, credential harvesting, impersonation, or fraudulent activity;
- spam, unsolicited bulk messaging, or abusive email practices;
- unlawful, defamatory, infringing, or harmful content;
- content or services that violate the rights of others;
- unauthorised scanning, scraping, penetration testing, or vulnerability testing;
- denial-of-service attacks or traffic designed to disrupt services;
- cryptocurrency mining or resource abuse without written approval;
- activity that may damage KloudStack, its customers, its suppliers, or third-party systems.
KloudStack may investigate suspected misuse and may suspend or restrict services where reasonably necessary to protect the platform, customers, third parties, or legal compliance.
12. Security
KloudStack uses reasonable technical, organisational, and administrative safeguards designed to protect the services.
However, no hosting, cloud, internet, or software service can be guaranteed to be completely secure, uninterrupted, or error-free.
You are responsible for maintaining strong passwords, protecting credentials, managing authorised users, reviewing access permissions, and securing customer-controlled applications, plugins, themes, integrations, and content.
You must promptly notify KloudStack if you become aware of a security incident, unauthorised access, credential compromise, or suspected vulnerability affecting your use of the services.

13. Backups and data recovery
KloudStack may provide backup, restore, retention, or recovery features depending on your selected service, configuration, or written agreement.
Unless expressly agreed in writing, backups are not a substitute for your own business continuity, compliance, retention, or archival obligations.
KloudStack does not guarantee that all data can be restored in every circumstance, including where data loss is caused by customer actions, third-party services, software corruption, malware, misconfiguration, deleted resources, expired retention periods, or events outside KloudStack’s reasonable control.
You are responsible for confirming that your backup and recovery arrangements meet your business, regulatory, and operational requirements.
14. Availability and status
KloudStack aims to provide reliable services and may publish service status information through a public or customer-facing status page.
Service availability may be affected by maintenance, updates, third-party providers, internet routing, cloud provider incidents, cyber incidents, customer configuration, or events outside KloudStack’s reasonable control.
Any service level agreement, uptime commitment, support target, or service credit will only apply if expressly stated in a separate written agreement or service schedule.
15. Third-party services
KloudStack services may rely on, integrate with, or interact with third-party services, including cloud infrastructure providers, payment processors, support systems, analytics providers, communication services, domain providers, DNS providers, software vendors, and application plugins.
Third-party services are subject to their own terms, policies, availability, security controls, and pricing.
KloudStack is not responsible for third-party services outside its reasonable control, but will use reasonable efforts to assist where third-party issues affect KloudStack-managed services.
16. Customer content and data
You retain ownership of your content, data, files, databases, websites, applications, and business information.
You grant KloudStack the rights reasonably necessary to host, process, transmit, back up, monitor, troubleshoot, secure, support, and manage your content and data for the purpose of providing the services.
KloudStack will handle personal information in accordance with its Privacy Policy.
You are responsible for ensuring that you have the rights, consents, notices, and legal basis required to provide customer content and data to KloudStack and to use the services.
17. Intellectual property
KloudStack retains all rights, title, and interest in its platform, software, tools, workflows, documentation, designs, branding, processes, know-how, automation systems, AI agent workflows, and service materials.
You must not copy, modify, reverse engineer, resell, sublicense, or misuse KloudStack intellectual property except as permitted by these terms or with written approval.
You retain ownership of your own content, data, trademarks, and business materials.
Feedback, suggestions, or improvement ideas you provide may be used by KloudStack to improve its services without obligation to compensate you, provided KloudStack does not disclose your confidential information without permission.
18. Confidentiality
Each party may receive confidential information from the other party.
Confidential information must be used only for the purpose of providing, receiving, supporting, or improving the services and must be protected using reasonable care.
Confidential information does not include information that is publicly available, already known without restriction, independently developed, or lawfully received from another source.
19. Privacy
KloudStack collects and handles personal information in accordance with its Privacy Policy.
Our Privacy Policy explains how we collect, use, disclose, store, and protect personal information, including information related to website use, platform accounts, billing, support, diagnostics, telemetry, and service communications.

20. Suspension and termination
KloudStack may suspend, restrict, or terminate access to the services if:
- you breach these terms;
- payment is overdue or cannot be processed;
- your use of the services creates a security, legal, operational, or reputational risk;
- your account is used for abusive, unlawful, or harmful activity;
- suspension is required by law, regulation, court order, or third-party provider requirement;
- continued service may harm KloudStack, customers, suppliers, or third parties.
Where reasonable, KloudStack will provide notice and an opportunity to resolve the issue before suspension or termination. Immediate action may be taken where required to protect security, availability, legal compliance, or other customers.
You may cancel your subscription or stop using the services in accordance with your plan, order, or agreement.
Termination does not affect amounts owed for services already provided or used.
21. Data export and deletion
Following cancellation or termination, KloudStack may provide a reasonable opportunity to export customer data where technically and commercially practical.
After termination, customer data may be deleted, retained, archived, or handled in accordance with applicable law, backup retention periods, operational requirements, and KloudStack’s Privacy Policy.
You are responsible for exporting or backing up any data you require before cancellation, termination, or deletion.
22. Disclaimers
To the maximum extent permitted by law, the services are provided on an “as available” basis.
KloudStack does not guarantee that the services will be uninterrupted, error-free, secure from every threat, compatible with every plugin or application, or suitable for every customer use case.
Nothing in these terms excludes, restricts, or modifies any right, guarantee, warranty, or remedy that cannot be excluded under applicable law, including the Australian Consumer Law.
23. Limitation of liability
To the maximum extent permitted by law, KloudStack is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss, including loss of profits, revenue, goodwill, business opportunity, data, or anticipated savings.
To the maximum extent permitted by law, KloudStack’s total aggregate liability arising out of or relating to the services is limited to the amounts paid by you to KloudStack for the affected services during the period specified in your applicable agreement, order, or service schedule.
This limitation does not apply to liability that cannot be excluded or limited under applicable law.
24. Indemnity
You agree to indemnify KloudStack against claims, losses, liabilities, damages, costs, and expenses arising from:
- your content, data, applications, or website;
- your breach of these terms;
- your unlawful use of the services;
- your infringement of third-party rights;
- security incidents caused by customer-controlled credentials, users, plugins, code, or configurations;
- instructions or actions provided by you or your authorised users.
25. Changes to these terms
KloudStack may update these terms from time to time.
If we make material changes, we will take reasonable steps to notify customers, such as by posting an updated version on our website, updating the effective date, or providing notice through the platform or email.
Your continued use of the services after the updated terms take effect means you accept the updated terms.
26. Governing law
These terms are governed by the laws of Victoria, Australia.
The parties submit to the courts of Victoria, Australia and the courts entitled to hear appeals from those courts.
